            The Commodity Futures Trading Commission (CFTC) submitted a landmark crypto market rulemaking to the White House on 17 September 2026, arriving just two days after the US Senate blocked the CLARITY Act from advancing. Concurrently, Bitcoin climbed above $86,000 to touch its highest valuation since January, supported by returning spot ETF inflows and a wave of short-position liquidations across derivatives markets. 

            The CFTC Filed Two Days After the Senate Vote

            The White House Office of Information and Regulatory Affairs received RIN 3038-AF80, titled Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets, from the CFTC on 17 September. It arrived two days after the Senate blocked the CLARITY Act, the crypto market structure bill that would have given the agency a statutory framework for spot trading.

            The legislative effort fell short of the 60 votes required to overcome a filibuster. Although a revised draft introduced ethics and conflict-of-interest restrictions for public officials, those adjustments did not resolve Democratic opposition. The CFTC filing is the only action from the agency awaiting White House review, and Michael Selig is its sole sitting commissioner.

            Proposed Framework: Establishing Regulated Crypto Asset Markets

            The filing’s outline suggests a new category of exchange called crypto asset markets, which would let existing and new venues offer spot trading in digital commodities such as bitcoin under CFTC oversight. The CFTC has not published the text, so the scope of that category and which tokens it would cover remain unconfirmed.

            The scope of the confidential submission points to the potential creation of a distinct regulatory exchange classification designated as “crypto asset markets”. Under this framework, existing digital asset platforms and new trading venues could register to facilitate spot and leveraged trading of non-security digital commodities under formal federal oversight. Because the regulatory text remains under interagency review, the precise boundary definitions and specific eligible token rosters have not been made public. 

            Because the CFTC regulations is acting without new legislation, a future commission could revise the rule, which is why the industry had pushed for a statute. The SEC and CFTC have already issued joint guidance on how digital assets are classified.

            Procedural Timeline: The 10-Day OIRA Prerule Window

            OIRA classified the submission under the “prerule” stage on Reginfo.gov. Under Executive Order 12866, the review window for preliminary administrative actions is structured for 10 working days, in contrast to the extended 90-day review period standard for proposed (NPRM) or final rules. As a result, initial White House review of the preliminary package is slated to conclude around 1 October 2026. 

            The next steps are a Commission vote, publication in the Federal Register and public comment. A final binding version of the CFTC crypto rules is unlikely to take effect before late 2027.

            Market Response: Bitcoin Touches Multi-Month Highs

            Bitcoin climbed above $86,000 on 21 September, its highest level since January, as spot ETF inflows returned and a wave of short liquidations forced bearish traders out. The rally followed the failed CLARITY vote and the CFTC filing within the same week, with the regulatory agencies moving ahead even as Congress stalled.
